Liability Terms and Conditions
PLEASE READ THIS CLAUSE
We do not store credit card details, nor do we share customer information with any 3rd parties whatsoever .
Delivery / installs will be completed within the agreed timescale on deposit of order .
A deposit or full payment is required from the customer to secure the date of installation and goods to be ordered in .
Call out deposit charges are nonrefundable due to travel time and fuel costs.
If a deposit is paid, then outstanding funds must be paid in full on the day of completion.
Full refunds can only be made up to 24 hours after the order has been confirmed or on the condition that no items/parts have been ordered, other than that then restocking fees of per item will be charged to cover return courier costs and restocking fees from the suppliers.
Items supplied by the customer require payment in full for labour upfront.
This is because the supplied goods maybe faulty or incompatible for the vehicle which we are not accountable for.
If the agreed date of install is cancelled less than 48 hours before the given date, then the full deposit paid will be lost to cover time / labour time lost on the installation booked .
If on the day the customer is not at the agreed installation address or has not contacted us or is uncontactable then deposits will be lost as we assign that time and day for the install in question, there for covering us for half / full days lost pay in labour .
If on arrival the install is cancelled by the customer a £150 charge is applied to cover travel , fuel and unused time lost because of the cancellation .
If the booking is cancelled on the same day, then again deposit for labour of installation will be lost .
If on the day of completion of installation customer supplied parts fail or are incorrect and cause non completion, any deposit will be lost and used against call out costs and labour used on the day.
All items ordered via the customer’s request for installation are subject to a 50% return restock charge if not used by the customer on each installation plus postage per item .
All parts come with a full 12-month warranty unless they have been subjected to any kind of water ingress due to damp, user damage or condensation which will make the warranty void!
6.1 If you have notified us of a problem with the goods within 30 days of delivery, the installer/sub-contractor will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question.
6.2 We shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions.
If a customer fails to be at the property of installation without notifying us when obtaining a call out/booking for repair or replacement parts service, then any further return call outs will be charged subject to milage, time traveling and fuel costs.
· 30 days-six months: You must give the retailer one opportunity to repair or replace it before you can claim a refund.
· Six months or longer: You must give the retailer one opportunity to repair or replace it before you can claim a partial refund, and the burden of proof is on you to prove the product is faulty.
This includes jobs cancelled due to non-delivery of goods or bad weather cancelling installs due to no fault of the company involved .
Our liability to you shall not in any event includes losses related to any business of yours, such as loss of profits or business interruption inc time out of work ;
neither will we be responsible to you for any other loss which is not a foreseeable consequence of us being in breach of these Terms and Conditions or our legal duties.
Refunds can take up to 7 working days to clear back to original source of payment …Thank you..
6.3 This does not affect your statutory rights if you are a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.
6.4 The customer is responsible for any goods provided by themselves therefore we cannot be held responsible for any faults that may occur with the product or to the vehicle that the customer has supplied inc no warranty can be given from us for provided goods by the customer .
6.5 Goods are intended for use in the UK only and we cannot confirm that the goods comply with any laws,
regulations or other standards applicable outside the UK. All goods are sold in accordance with the manufacturer’s specifications and are subject to any qualifications,
representations or instructions contained in the documentation associated with the goods.
6.6 If you are a trade customer and subject to Clause 6.3, we will not be responsible to you or,
in the event that you are undertaking work for another person, to any other person, for the use or installation of any goods by you.
Accordingly, if you are a trade customer, you hereby agree to hold us harmless, and indemnify us against any liability associated with,
any claim or allegation that we are responsible for any failings in the installation or use of goods that we supply.
All work carried out is guaranteed by the installer we have subcontracted to for a full 12 months inc parts subject to section 6.4 and are exempt to any miss use of goods ( this does not include any parts/items the customer has provided ) .
If a fault occurs after installation, then an inspection from us the supplier can be carried out to inspect any damage to the goods before either repair or replacement.
Goods will NOT be covered by our warranty/refund if a 3rd party company have intervened in any way.
Goods that are faulty will be repaired or replaced within a 12-month period of installation but not refunded under any conditions including change of mind or inadequate performance due to an incorrect customer choice of agreement of products upon ordering.
We have a duty and right to inspect a fault if one ever occurs, correct/repair (not refund) according to the fault in question.
6.5 Customers having installation work carried out in any of our fitting bays must leave the car with us as they won`t be covered by our insurance if they trip or fall within the working area.
The mobile installation provided is for the first main install of goods.
Repair work to installation or products after 2 weeks if required is to be carried out at our premises only.
Corrosion to goods will not be covered under warranty.
Upon installation sometimes vehicles can require additional extra adapter leads or at a later date can require additional leads which will be at a cost to the customer parts, labour and call out.
Because we provide a nationwide install service, we do contract some of our work out due to availability of installers or traveling distances there for giving all our customers a first class service and knowing the installer will be close by at all times.
